By downloading, installing, or using CrowdMate ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

The App may contain links to third-party websites or services (such as ticket sellers). We are not responsible for the content, privacy policies, or practices of third-party sites.

While we strive to provide accurate concert information, we do not guarantee the accuracy of event details, dates, times, or venue information. Always verify event details with official sources before attending.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

To the maximum extent permitted by law, ClairAI SASU shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or 100 euros, whichever is greater.

We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App will cease immediately.

We reserve the right to modify these terms at any time. We will notify you of significant changes through the App or via email. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of France. In the event of a dispute, the parties agree to first attempt to resolve the matter amicably through good faith negotiation. If no resolution is reached within thirty (30) days, the parties may seek mediation before pursuing litigation. Any disputes that cannot be resolved through negotiation or mediation shall be subject to the exclusive jurisdiction of the courts of Paris, France.

16. ConcertAPI Service

16.1 API Description

ConcertAPI is a paid application programming interface (API) service that provides access to concert and live event data. The API is a separate service from the CrowdMate mobile application and is subject to additional terms outlined in this section.

16.2 API License

Subject to your compliance with these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the ConcertAPI solely for your internal business purposes or application development.

16.3 API Provided "As Is"

THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. We expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to:

We do not guarantee any specific uptime, availability, or performance level for the API. The API may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the API (or any part thereof) at any time with or without notice.

16.5 Data Accuracy

Concert data provided through the API is aggregated from various sources. We do not guarantee the accuracy, completeness, or timeliness of event information including but not limited to dates, times, venues, artists, ticket prices, or availability. You are responsible for independently verifying any data obtained through the API before relying on it.

16.6 API Key Responsibility

You are solely responsible for maintaining the confidentiality of your API key. You must not share, publish, or expose your API key. You are responsible for all activity that occurs under your API key. Notify us immediately if you suspect unauthorized use.

16.7 Usage Restrictions

You agree not to:

We reserve the right to modify the API, including endpoints, data fields, response formats, and rate limits, at any time. While we will make reasonable efforts to communicate significant changes, we are not obligated to maintain backward compatibility.

API access requires a paid subscription. Fees are non-refundable except as required by law. We may change pricing with 30 days notice. Failure to pay fees may result in suspension or termination of API access.

16.10 API Termination

We may suspend or terminate your API access immediately if you violate these terms, fail to pay fees, or if we determine that your usage poses a security risk or negatively impacts other users. Upon termination, you must immediately cease all use of the API and delete any cached data.

16.11 Limitation of Liability for API

IN NO EVENT SHALL WE BE LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE API. Our total liability for any claims arising from the API shall not exceed the fees you paid for API access in the three (3) months preceding the claim.

16.12 Governing Law and Dispute Resolution

Your use of the ConcertAPI is governed by the laws of France. In the event of a dispute, the parties agree to first attempt to resolve the matter amicably through good faith negotiation. If no resolution is reached within thirty (30) days, the parties may seek mediation before pursuing litigation. Any disputes that cannot be resolved through negotiation or mediation shall be subject to the exclusive jurisdiction of the courts of Paris, France.
